1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "user," or "participant") and Evasive Escape Rooms ("we," "us," or "our") governing your use of our website evasiveescaperooms.com and your participation in our escape room experiences. By accessing our website or booking and participating in any escape room, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not use our website or participate in our experiences.

2. Services Description

Evasive Escape Rooms provides immersive, story-driven escape room experiences at our Sarasota, Florida location. Each experience involves solving puzzles, riddles, and challenges within a themed room within a set time limit. Our services include public and private bookings, team building events, gift vouchers, and special event hosting. All games are private — you will not be paired with strangers.

3. Bookings and Reservations

• Bookings are made through our online reservation system or by phone and are subject to availability.
• All bookings are confirmed only upon receipt of payment or deposit as specified at checkout.
• Each room has a minimum and maximum number of participants as indicated on the booking page.
• Arrival is required at least 15 minutes prior to your scheduled start time. Late arrivals may result in a shortened experience or forfeited booking without refund.
• We reserve the right to refuse service to any individual or group for any lawful reason.

4. Cancellation and Refund Policy

• Bookings may be rescheduled with at least 48 hours' notice prior to the scheduled start time, subject to availability.
• Cancellations made less than 48 hours before the scheduled start time are non-refundable.
• No-shows or late arrivals beyond 15 minutes of the scheduled start time will forfeit the full booking amount.
• Refunds, if applicable, will be processed to the original payment method within 5–10 business days.
• If Evasive Escape Rooms cancels a booking for any reason, a full refund or rescheduling option will be provided at no cost to you.
• Gift vouchers are non-refundable but may be transferred to another person.

5. Assumption of Risk and Waiver of Liability

Participation in escape room experiences involves physical activity, mental challenges, and interaction with props, set pieces, and theatrical effects including but not limited to dim lighting, loud sounds, confined spaces, and live actors. By participating, you acknowledge and voluntarily assume all risks associated with the activity, including the risk of injury, property damage, or emotional distress.

You agree to release, indemnify, and hold harmless Evasive Escape Rooms, its owners, employees, agents, and affiliates from any and all claims, liabilities, damages, or expenses (including attorney's fees) arising from or related to your participation in any escape room experience or your use of our website and services, except to the extent caused by our gross negligence or willful misconduct.

Participants under 18 must have a parent or legal guardian sign a waiver on their behalf. Minimum age requirements vary by room and are listed on each experience page.

6. Participant Conduct and Rules

All participants must adhere to the following rules:

• Do not use excessive force on any props, locks, doors, or set pieces. If something requires force, it is not part of the game.
• Do not climb on, move, or dismantle set pieces or furniture unless explicitly instructed.
• Do not bring outside food, drinks, alcohol, or illegal substances into the escape rooms.
• Participants suspected of being under the influence of drugs or alcohol will be refused entry without refund.
• No cameras, phones, or recording devices are permitted inside the rooms during gameplay.
• Respect staff and other participants. Abusive, threatening, or disruptive behavior will result in immediate removal without refund.
• Follow all instructions provided by staff before and during the experience.

7. Pricing and Payment

All pricing is listed on our booking page and is subject to change without notice. Payments are processed securely through our booking platform. Prices are per participant unless otherwise stated. We reserve the right to offer promotions, discounts, and group rates at our discretion. Applicable Florida sales tax is included or added at checkout as indicated.

8. Gift Vouchers

Gift vouchers purchased through our website have no cash value, are non-refundable, and cannot be exchanged for cash. Vouchers must be redeemed by booking an experience through our website or by phone. Vouchers expire one (1) year from the date of purchase unless otherwise stated. Expired vouchers cannot be redeemed or extended.

9. Intellectual Property

All content on our website, including text, graphics, logos, images, room designs, puzzles, storylines, and software, is the property of Evasive Escape Rooms or its licensors and is protected by United States copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or use any content without our prior written consent.

Sharing, publishing, or disclosing any puzzle solutions, room layouts, or proprietary game content is strictly prohibited and may result in legal action.

10. Website Use

When using our website, you agree not to:

• Use the site for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to our systems, user accounts, or data.
• Introduce viruses, malware, or other malicious code to the site.
• Scrape, copy, or harvest data from the site using automated tools.
• Impersonate another person or misrepresent your affiliation with any entity.
• Interfere with the proper functioning of the site or the experience of other users.

11. Limitation of Liability

To the fullest extent permitted by law, Evasive Escape Rooms and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of our website or participation in our experiences. Our total liability for any claim arising from these Terms or our services shall not exceed the amount you paid for the specific booking or service giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Evasive Escape Rooms, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms, your misuse of our website or services, or your violation of any law or the rights of any third party.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved exclusively in the state or federal courts located in Sarasota County, Florida. You consent to the personal jurisdiction of these courts.

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with an updated revision date. Your continued use of our website or services after any changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

15. Severability
